1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the services provided by Charmane Business Solutions ("we," "us," or "our"), including notary services, business operations support, digital transition consulting, and our website at charmanebiz.com. By using our services, you agree to these Terms.

2. Services Provided

Charmane Business Solutions provides the following services in Florida:

• Mobile, in-office, and meet-up notary services
• Remote Online Notarization (RON)
• Real Estate document notarizations (non-signing agent services)
• Apostille and document authentication coordination
• Business operations support and consulting
• Digital transition and workflow systems consulting

3. Not Legal Advice

We are not attorneys and do not provide legal advice. A notary public is a public official authorized to perform certain acts, including witnessing signatures and administering oaths, but is not authorized to:

• Provide legal advice
• Prepare or draft legal documents
• Choose the type of notarial certificate
• Determine whether a document is legally sufficient for its intended use

If you need legal advice or assistance with document preparation, please consult a licensed attorney.

4. Client Responsibilities

When using our notary services, you agree to:

• Present a valid, unexpired government-issued photo identification at the time of notarization
• Ensure all documents are complete (filled out except for signatures) before your appointment
• Have all required signers present and able to communicate clearly with the notary
• Provide accurate information when booking
• Be available at the scheduled time and location

5. Pricing and Payment

Pricing for our services is published on our Services & Pricing page. Final pricing is confirmed before service is rendered based on the specific details you provide. Payment is processed through Square. Payment is due at the time of service unless other arrangements are made in advance.

6. Cancellation and Rescheduling Policy

We require 24 hours' notice for cancellations and rescheduling. Cancellations or no-shows with less than 24 hours' notice may forfeit the service fee or be subject to a cancellation charge. We reserve the right to cancel appointments due to unforeseen circumstances, in which case any pre-paid fees will be refunded or rescheduled at your preference.

7. Apostille and Document Services Disclaimer

Apostille and government document authentication services involve coordination with state and federal agencies. Processing times for apostille certifications are determined by the issuing government agency and are outside our control. We provide estimated timeframes in good faith but cannot guarantee specific processing dates. Government fees and shipping costs are separate from our service fee and are passed through at cost.

8. Remote Online Notarization (RON)

Remote Online Notarizations are performed in compliance with Florida law (Section 117.201–117.305, Florida Statutes). All RON sessions are recorded and retained for ten (10) years as required by law. By using our RON services, you consent to being recorded.

9. Refusal of Service

We reserve the right to refuse service if:

• A signer cannot present valid identification
• A signer appears to lack the mental capacity to understand the document or transaction
• A signer appears to be acting under duress or coercion
• The document appears to be incomplete, fraudulent, or otherwise improper
• Any other circumstance arises that we believe prevents a lawful and proper notarization

In such cases, our standard service fee may still apply for time and travel.

10. Limitation of Liability

To the maximum extent permitted by law, Charmane Business Solutions' total liability arising from any service shall not exceed the amount you paid for that specific service. We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, lost business opportunities, or document rejection by receiving parties.

11. Confidentiality

We treat all client information and documents with confidentiality. However, certain disclosures are required by law, including for notary recordkeeping, court orders, and government investigations.

12. Intellectual Property

All content on our website, including text, images, logos, and design, is the property of Charmane Business Solutions and is protected by copyright law. You may not reproduce, distribute, or use our content without our written permission.

13. Third-Party Services

Our website integrates with third-party services including Square (payment processing), Google (email and scheduling), Tally (forms), and Netlify (hosting). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or policies of third-party services.

14. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising from these Terms or our services shall be resolved in the state or federal courts located in Florida.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the revised Terms.
